1. How to identify the applicable rules within a Company
  • sources of employment law
  • mandatory rules provided by Collective Bargaining Agreements (CBA)
  • mandatory rules provided by internal rules and regulations
  • consequences of changes in legislation, agreements and case law

2. Analyze the different steps of an employment contract
  • the recruitment process
  • dealing with employment contracts (fixed term contracts, part-time, indefinite term contracts)
  • analyze the mandatory provisions of an employment contract (trial period, remuneration, working time etc.)
  • dealing with additional provisions (confidentiality clause, mobility clause, non-compete, non-solicitation, non-dealing, non-poaching, garden leave etc.)
  • the evolution of the employment contract (distinguishing the modification of the employment contract and a simple change of the working conditions, procedures to be followed etc.)
